Iowa Multiple DUI Offense Attorney

Consequences of Multiple DUI Offenses

Although one DUI conviction is a serious offense, when you have multiple offenses, you can expect much more serious fines, charges and penalties.  If you are dealing with such a situation, it is vital you contact a criminal defense attorney to represent you on the matter. When facing a first DUI offense you can expect fines, a jail sentence of 48 hours and up to one year in jail and license suspension. With a second or subsequent DUI conviction, however, you are looking at a substantially serious situation.  The charges carry the following consequences if convicted:

  • DUI SECOND OFFENSE - Aggravated Misdemeanor.  Fines from a minimum $1,875 - maximum $6,250; Jail from a minimum 7 days in jail up to 2 years in prison; License Suspension of 2 year revocation (if not suspended/revoked administratively)

  • DUI THIRD OR SUBSEQUENT OFFENSE - Class D Felony - Fines from a minimum $3,125 - maximum $9,375; Jail from a minimum 30 days - maximum 5 years in jail; License Suspension of 6 year revocation (in addition to revocation issued administratively)
  • DUI SERIOUS INJURY BY MOTOR VEHICLE - Fines from $750 - $7,500; Jail time of a mandatory 5 years in prison; License Suspension of 1 year (in addition to any administrative revocation);  In addition, mandatory substance abuse evaluation, drunk drivers course, restitution.
